These Terms of Use govern your access to and use of Radio Theater AI and any related websites, applications, APIs, features, and services provided by or on behalf of Radio Theater LLC (the Service). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

Using the site means you agree to these Terms. If you do not agree, you may not access or use the Service. We may update these Terms from time to time, and your continued use after changes take effect means you accept the updated Terms.

2. Service Description

The Service is an AI-powered video generation platform that supports text-to-video and image-to-video creation. Some features may require an account, credits, or payment.

3. Accounts

You agree to provide accurate information when creating an account and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Credits and Payments

Credits are required before generation begins. Pricing varies by duration and resolution, including 480p and 720p tiers. Purchases are handled via Stripe and are subject to Stripe's terms and policies in addition to these Terms.

5. Refund Policy

If a generation fails due to a system or API error, the full amount charged for that generation is refunded. If content is rejected by moderation, the user is charged fifty percent (50%) of the original charge and fifty percent (50%) is refunded. No refunds are provided for successfully generated videos unless required by law or otherwise stated in writing.

6. Moderation

Content may be rejected by moderation or other safety systems. We do not guarantee that all prompts or images will be accepted, processed, or returned as outputs.

7. User Responsibility

You must not upload or request illegal, harmful, infringing, defamatory, harassing, exploitative, sexually explicit, deceptive, or otherwise objectionable content. You remain responsible for your prompts, uploads, and any use of generated content.

8. Intellectual Property

To the extent permitted by law, you own the rights to your original inputs and, subject to these Terms and third-party rights, you may use your generated outputs. Radio Theater LLC retains all rights necessary to operate, maintain, secure, and improve the Service, including the software, interface, and system logic.

9. Account Termination

We may suspend or terminate accounts for abuse, fraud, policy violations, or legal risk. Users may also delete their accounts, which is handled as a soft-delete so the account is marked inactive rather than fully erased.

10. Limitation of Liability

The Service is provided on an as-is and as-available basis. We do not guarantee uptime, availability, output quality, or that outputs will meet your expectations. To the maximum extent permitted by law, Radio Theater LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules, except where otherwise required by law.
